My jurisdiction is: Kansas

I have been divorced for 5 years with a VERY amicable relationship with my ex. He is currently married with a new baby. We have a 10 year old son. My ex started having seizures a year and a half ago and has lost his driving priviledges. I have noticed a huge change in his personality in the last 6 months. Aggressive, Paranoid, issues with memory, etc. I figured it had to do with his seizure medication. Found out last night that for the last 6 months he has been struggling with alcoholism. He is on anti-seizure meds, anti-anxiety meds, and drinking to the point of passing out 3 -4 nights a week. He disappeared last night and the police were involved in the search. He finally drove himself to the hospital and asked to be admitted to the rehab center. They did not admit him.

We have joint custody, but no parenting plan filed with the court. I fear that my child is not safe with my ex at this point - and I no longer trust the new wife as they kept this information from me. My ex has been taking care of our son during the day while I am at work.

Can I file a temporary order for sole custody until my ex gets things under control? Would the court grant the request?
