I paid a tax preparer to complete my 2006 federal tax return. After being audited by the IRS it was discovered that she had done my taxes incorrectly. She had deducted many things that were not tax deductable, such as realtors commission, credit reports, closing costs & items related to the sale & purchase of my home. Some of the items she had listed more than once with different wording. And on my 2007 taxes she deducted things that I never even mentioned I had such as meal & entertainment expenses, so now I have to have those taxes amended before trouble strikes.

I have asked her for a refund of her services, since I paid for a service that was done incorrectly & has now costed me a great deal of money. Am I entilted to a refund or can I take her to a small claims court?

If you're entitled to a refund, small claims court will award this to you. You may wish to send her a demand letter first - it will save time, money and give you extra ammunition in court. Good luck.
