Swerved to avoid rear end collision,struck bicyclist killing him!

This happened in the town I am from. A police officer on a non emergency call swerved to avoid hitting a car stopped in front of him and struck another vehicle and a man on a bicycle killing him. The officer was reported to be following the speed limit and the victim was on a bmx bike with no reflectors at 11 pm.

Can the officer be held legally responsible for this mans death?
