My boyfriend and I have been together for four and a half years and are expecting our first baby ANY day now. We live in the state of Tennessee and unfortunately he's probably not going to make it to the birth due to his unfortunate incarceration and the courts holiday schedule. My question is, will I legally be able to give our baby his last name if he's not able to attend the birth? Not having him there is going to be hard enough, but not being able to give his new son his name is going to be even worse
