The mother has on several occasions kept the kids longer than the court order allows, once was only by a day, the other by an entire week. We have custody of one already (we are residential) and because she continues to ignore the court order, keep in contact with father regarding other childrens school events etc. and keeps them longer than court order allows (everytime she has taken them out of state) we are asking for sole custody of the one where he is residential parent and asking for her to have supervised visitations since we cannot trust her to return the children when they are supposed to be back. Are we valid in our reasoning and will the magistrate most likely see what the mother has been doing or what she could do in the future? She also makes visits with the one child very difficult and often sends him to her parents house to spend the night during her visitations with him and yells at him constantly, drinks with the kids at her bfs house and then drives home, etc. I could go on and on... but the main concern is her believing she can take the kids whenever (she took them early from school when it was not her weekend - took them out of the state - and caused them to miss our wedding that they were all supposed to be in) and returning them whenever she feels like it in complete violation of the court order.
