My fiance and I had rented a unit in maine for almost a year when her orders changed and she was to be moved to massachussets. There was a military clause in the lease which released her from the lease itself, and we have a letter proving the landlord released us from it. Now we were to leave Early september and were not able to give a 30 days notice at that time, and we agreed our security deposit would be forfeit. But when we found out that we wouldn't be moving for another month, we payed for septembers rent and told the landlord we would be leaving on the 5th of October. When we left she refused to give the security deposit because she said she hadnt released us from the lease and given her 30 days notice, but obviously we had a letter stating so, and which meant we payed simply to stay an extra month but not under the same lease agreement as before because it had been ended. Well we moved to Mass. and my fiance had already been pregnant for a month at this time when in November the landlord contacted her Commander, which she works under, and continued to talk with him behind her back. We have written letters from her to him, stating that she owed her excessive amounts of money and that she did this to her self, she was her own worst enemy, and that she was a horrible person for doing so and would make it hard on other military familys trying to find homes around her area now. Now obviously we have already won the case against her, and it turns out that in fact the landlord actually owes us over $2,600 dollars, but even furthor more, after the landlord said such things about my fiance, she was then given a Letter Of Reprimand, a step down from an article 15 which would hinder her whole military career and could possibly end it if not removed. She then appealed the LOR and was still given a Letter Of Counsil which is a step down, but still demeaning. :no:
My question to anyone who can answer is do you think we could possibly come away with something because of this. Its hard to put an exact amount on what has been lost or what could have been, but looking at it this way, how she has been so stressed because of this whole ordeal that was not needed at all in the first place. Shes been in and out of the hospital numerous times, missing work, has seen therapy to help cope and all this has affected our unborn child imensly. Even if this would be erased from her file, she still has another 3 years at the same place under the same commander who can not forget what has transpired. How and what would be a good idea of the montetary value of this against her. How much do you think would be appropriate to sue her for?
