I have come up with a situation where a tenant has subleased a condo to someone else. in the original lease it does not allow for any subleasing at all. the subtenant found our rental company who legal manages the property, to ask why no one has done anything about a moldy wall. the sub was informing the original tenant who failed to say anything to the property manager. what are our rights to remove all the tenants and can we take possession to correct the damages?
 
Yes, you can have the so called, sub-tenant evicted.
To do that, you'll have to bring an eviction action in your local court.
Be prepared for it to take six to eight weeks.
Your remedy is to seek possession.
I wouldn't worry about collecting rent.
In many of these cases, you can't.
If the tenancy is illegal, courts are reluctant to enforce illegal agreements.
Sue for possession.
The process starts with you sending the offenders a certified, return receipt letter to quit (leave) the property.
