Hi I work at trucking company as a security officer and while I was in the parking lot of the trucking company going through the gate a police officer turned his lights on and stated that i was speeding down the street. He had to get out of his car to read my tag the trucking company has cameras to verify the stop. Is this stop even legal being that I was on commercial property? I wasn't speeding, how can o have this charge thrown out of court?

    Thank you

The officer's version of events probably state that you were pursued or followed onto private property, then cited for speeding.

Your written citation the officer handed you most likely reveals the location of the initial encounter.

However, telling an anonymous internet loser your story who is powerless to assist you, would simply be wasting your time.

I suggest you schedule consultations with a couple traffic lawyers in your county.

Usually the first meeting is offered at no cost, and you can ask questions about the charge and how best to proceed to address the citation.

If you can take an online traffic school (driver improvement course), or whatever name is used in your state, that is the BEST way to cure any harm the citation might cause.

Were you on the road immediately prior to being stopped? If so, having reached the gate doesn't stop the police from citing you. It's about where the violation occurred, not where the so was eventually made.

If you were never on the road at all then you have something to argue.

That's what they all say. What's your proof? The location of the stop means nothing.

You can't. Your case gets adjudicated and then a judge will decide your guilt.

You have provided no basis for your case to get "thrown out".

Given that the alleged crime occurred on a public street, what would possibly make you think that you being "on commercial property" has anything to do with the legality of the stop?

You're obviously free to contest the ticket in court, but you're not going to "have [the] charge thrown out" simply because you deny it.
