I sold my house Subject to the seller's existing first mortgage and it has been recorded but the mortgage company won't accept it. The tenant agreed to put the property back into my name. Should I use a deed of gift or quitclaims deed?

At this point to ensure no further snafus, I suggest you discuss this matter with a licensed real estate attorney in your county.

I sold my house Subject to the seller's existing first mortgage

So...you sold the house but your mortgage wasn't paid as part of the process?

it has been recorded but the mortgage company won't accept it.

Please explain what this means.

The tenant agreed to put the property back into my name.

The tenant? You mean the buyer?

Should I use a deed of gift or quitclaims deed?

This question calls for specific legal advice which cannot be reliably obtained from anonymous strangers on the internet. I strongly suspect this transaction was done improperly from the very start, so I suggest you not compound mistakes and consult with a local real estate attorney.
