I went to a small tech school that allowed me to make payments for $5,000 that I could not get a loan for . I had been making payments after I had graduated and requested my transcripts for licensure to start a new job. The school refused to release my transcripts. I got behind on my payments and now they have filed a small claim suit against me for $9,000. The date on the agreement is 02/10/2010. Does this exceed the statue of limitation? If so how do I proceed?
 
Utah's SOL on a Written Contract = 6 years.
Assuming you never made any payments, by your admission of the contract date of Feb. 10, '10; the note holder has one year remaining in which to file a SC lawsuit.
Being one was recently filed, no issue with the timing of their suit.
