Single mother of 2 wanting to sign over rights

I am a single mother of 2 boys, their father is in jail but I am wanting to sign over my rights. I cant take care of them and the fathers mother said that she would be glad to have them. Is this even possible with the father being in jail?
 
Do you know exactly what you are asking? first of all you cannot just sigh over your rights. That is a legal process and you would basically be abandoning your kids.

If you want to give guardianship over to your mother in law you can do that. What is the reason you cannot take care of them? There has to be help for you. You are probably eligible for welfare or some sort of assistance. If you honestly feel your mother in law can care for the kids then give her guardianship BUT is she able to support them without financial help from the gov't? If she goes on gov't assistance she will be forced to file for child support.

You need to think about what you are doing here. You do not want to permanently give up your children do you? also dad still needs to consent to this anyways. His rights are not being terminated and when he gets out he can challenge the guardianship.
