secondary extended warranty

I bought an extended unlimited warranty with my used car. it had 99,235 miles on it when I bought it. The transmission failed which is covered in the warranty. The service center has determined the pump failed and there was nothing wrong with the fluid. The warranty company refuses to pay because I did not get the 100,000 miles check up the manufacture has in their owners manual. They accepted the warranty when I bought it knowing it had 99,000 plus miles. Do i have any claim here?

They could "know" that you wear green socks and that would have no more to do with the terms and conditions of your contract than "knowing" that the car had 99.000+ miles on it.

If you don't understand the terms and conditions of your contract (which we can't see from here) take it to an attorney for review.
