Screen name/trademark

I recently completed a trademark search for my proposed trademark. Only one situation came up that concerned me. Someone's existing screen name/user name on Flickr (A photo sharing community site) is the same as my proposed trademark. I did not obtain an Attorney and went ahead and applied for a trademark. I already obtained the domain for the name. Can Flickr pursue any legal suits against me?

1) A user name should not constitute a "mark in commerce."

2) Even if someone created a user name, what does that prevent you from registering a trademark? I doubt that Flickr has even thought about registering a mark for a screen name - good luck!
