Rules for legal guardianship

My girlfriend and I are trying to get legal guardianship of her 14 year old brother as his mother is terminally ill. Now she is 20 and I am 24 and i am aware that we are kind of young how much does that matter? She is the only relative that can take him, all others are drug addicts. A couple from his church have been going behind our backs and trying to set up other families who him nor his mother even know. What does the law say in this situation? Would it help to be married? What kinda of income should we have if any? Thanks alot.
 
What does the mother say in terms of all of this? She should be the one (unless she is so incapacitated with her illness) who should be able to decide whom she wishes as the legal guardian for her son. Is there a father present?
