I am the primary on an auto loan with a co-signor. The other party and myself agreed that they would handle all of the financial responsibilities of the vehicle. I recently found out that the account is 2.5 months past due. I've called the other party and sent text messages to no avail. I sent a notarized letter (certified mail w/return receipt) requesting the vehicle be given to me. I don't mind taking over the loan payments but I want possession of the vehicle before I begin paying. Can I legally have the car towed or repossessed if I haven't made any payments on the loan? If not, what else can I do?
