Hello, I have a bit of a crazy situation and hope you can give some insight?? I have been living with my husband for past 7yrs completely seperately, due to some health problems on my part and the fact that i have dogs and was not in a position to move with them. He has been becoming more and more aggressive and intimidating as i have recently started a business and have been finding support. Since i have been getting out more, he is extremely angry, despite not caring that i was there for past 10yrs, as he spent time in garage and wanted nothing to do with me. Recently, i found lingerie ripped up all over the house, he has been going through my room, car, phone and accusing me of having boyfriends ect. He has called me a whore and really shook me up with his emotional abuse. Last week he put pepper spray on my personal feminine items and caused a lot of physical pain. I took 10 protection, so he was escorted off property and we will be going back to get extended. Do you have any idea of the legal category this type of behavior would be, as the sheriff called it assault on personal property, but i call it assault on me??? Any help would be greatly appreciated. Thank You!!

Is this a typo? I don't quite follow you here.
I'm assuming this is where you called the police and got a temporary restraining order?
Was he arrested or did he leave as a result of the order?

There is likely a state statute regarding the use of pepper spray, however it likely applies to directly spraying it at someone. I would expect that by doing this it would be sufficient for a domestic violence offense- though kind of an odd one.

If he was arrested it was most likely on a domestic violence offense. If he was not arrested, then what you have is a civil problem. Either one of you can leave the house at any time to avoid these problems, and either one of you can file for divorce... or you can both seek counseling.
 
Finding pepper spray on an item, doesn't prove who might have put pepper spray on the item.
Unless he admits to doing something, all you have are allegations and suspicions.
 
So you have been living for the past 7 years, with hubby footing a majority of the bills. You finally have managed to find a way to earn money and started stepping out. Hubby got mad that you are more interested in getting a "friend", than getting of his buck and reacted. Now you want to put the screws to him as hard as you can on the way out, as a way of saying thanks. I think this sums up your post, correct?

your case is just similar to my sister. Have you got any solution? I am thinking of hiring a good lawyer and solve the matter ASAP
