My ex-husband and I have three children, we were divorced in 2002. In 2003 my ex-husband and I decided to joint custody; we agreed to physical custody of two for him (my daughter and oldest son) and physical custody of one for me (our youngest son). The state issued a child support order, which we requested be dismissed in 2004; the request was accepted.
At the beginning of May, my 12 yr old daughter reported sexual abuse that she claims occured 5-6 yrs ago, by my ex-husbands friend and ex-wife. I was informed on May 19, 2009 and spoke with CPS May 22, 2009. CPS request that I come to Allen County (I reside in Texas) since I have joint custody and bring my daughter in, due to concerns regarding the report. At this point my ex-husband and his current wife refused to allow contact with my children and I ( the current marriage is less than one year). They have retained counsel and have filed a notice of contempt because I moved out of state. My move was in 2004 and all of the children moved with me. My oldest son went back in 2006 and my daughter went back in 2007. My ex-husband and his attorney stated via e-mail today that I can not have visitation with my daughter unless it is supervised, because I have not seen her since Feb. 2008. They state she is unfamilar with me and needs to get to know me again, among various other reasons. My ex-husband and his current wife have withdrawn my daughter from public school without my permission or knowledge. This lawyer e-mails me up to six times a day and he makes negative comments towards me.I need help.

You need to retain a lawyer in the state that has jurisdiction (Allen County? Kansas? Ohio?).

I have tried, but every lawyer I have talked to tells me that it will be $10,000.00 just to touch my case. Some have any told me that I won't win, because the law does not define "child abuse" outside of physical or sexual. Although I do have a phone conference with an attorney Monday whomay take my case and require only a $600.00 retainer. Keeo your fingers crossed. Thanks

I don't understand your reference to child abuse, other than the abuse regarding your daughter and your ex's friends. Are you claiming that your ex and his wife are committing child abuse? I don't see any signs or evidence of abuse by them in your posting.

I assumed that you wanted to address the charge of contempt, the denial of visitation, your daughter's change in schooling, and his lawyer's harassment. Perhaps if you focus on those issues, it will not be so costly.
