My ex-husband and I divorced in 1998. My daughter is ten years old. For the first two years of my daughter's life, the courts declared that her father's visits were to be supervised. He had a history and record of substance(primarily alcohol/duis) abuse. After the two year time period, the X really showed signs of improvement, not drinking around daughter during visits. The visits were not consistently scheduled by the X until my daughter turned 5, but were pretty positive experiences for the child. From age 5 on, things have moved along rather smoothly. The X moved home to Kentucky and atleast one weekend a month(sometimes 2), we meet at the state line to exchange our daughter. She has seemed to progress very well with this arrangement. However, over the Thanksgiving break something disturbing happened. The X had too much to drink, got in an argument with a family member, flipped a table, cursed the family member out, grabbed my daughter, put her into his truck, proceeded to hit a mailbox in route to his mother's home. When he got to his mother's home, he passed out on the couch. My daughter was terrified. She called me very shaken up.
Do I have any rights? My first inclination is to prohibit her from seeing him. However, I know that I am ordered by the court to comply with visitation. I have always maintained a good relationship with the X. But as I see it, he was driving under the influence which endangered her life. He hit a mailbox which is a felony. He flipped a table and used very aggressive, inappropriate behavior which caused my daughter to become fearful for her safety. Then on the following day, he instructed her to keep silent and not tell me about the incident. I am furious. Please tell me what your thoughts are...Should I consult with an attorney?
