Removing name off ex's mortgage

My ex-girlfriend purchased a house prior to me moving in with her.

After I moved in we re-financed the mortgage and added my name.

We figured it would be good for my credit to have my name attached.

Now we've been split up for over a year and I want to know what my options

are to have my name removed? The mortgage lender advised me to have

her refinance without my name but my ex refused to refinance because her

credit isn't as good as it was previously and she's afraid if she refinances

her apr will be really high. Does anyone have any suggestions on

what I can do, either with or without her cooperation?

2 THINGS.

You are probably going to have to take her to court. A judge can force her to refi the house in her name only.

2) If you have equity in the house, you are probably entitled to it, unless you want her to refi and she gets it all. You can use that as a bargaining tool, if the house keeps going up in vlaue, the more she leaves your name on it, the more money you will get once she finally decides to sell.

Reading the post above it sounds like his name is on the mortgage only-not the deed so your #2 above may not be correct. Couldn't she sell the house without even letting him know? He doesn't have to sign anything to pay the mortgage off. So that one may be a really tricky bargaining tactic.

Generally when you refi, they mortage company puts you on the deed as well. If he is not on the deed, then he should file a motion in court requesting she be forced to either sell or refi into her name only.

If he is on the deed then he might have some bargaining power.
