Re-gaining custody in Michigan

I am in Michigan, Kent County.

My son's father and I were never married. His name was not on the boy's birth certificate until recently.

My ex and I have joint custody of him and he currently has physical custody. He is not taking care of the boy and I want him back as I am now able to provide a much better home for him than my ex is providing. My ex objects.

EXACTLY what form do I need to fill out to file with the court to get this ball rolling? The only forms I find clearly state that they are not to be used for beginning a new change of custody case, but I cannot locate the one that I need that will allow me an opportunity to do this.

I know that I need an attorney, but I just don't have the money. I have too much for legal aid and not enough to pay for one myself. My ex is about to take the boy and move out of State. The FOC and CPS doesn't believe me or something. HELP!!!
 
Changing custody is going to be hard. Just because you feel he is not taking care of the child doesn't mean he is not. Have you called legal aid to see if they will help? CPS is not going to get involved unless you have [proof without a doubt the child is being physically abused, or neglected.

You can do down to the courts and see if there is a family law fascilitator there. Your ex just cannot get up and move out of state. What does the order say in regards to that? You can definiltely dispute the move. Have you been utilizing all your visits and paying child support?
