Below is a disclaimer found on a web site of a company that is raffling off a $1.2 million home. 18000 tickets to be sold at $150 ea. Based on all laws I've read this still constitues cyber gambling. How do they get around this law?

"In accordance with California Penal Code Section 320.5: (1), this web site is intended by DesertArc to be an announcement of its raffle and is not intended to be an advertisement; (2) this raffle is not being advertised, operated, or conducted in any manner by DesertArc over the Internet; and (3) DesertArc is not selling, trading, or redeeming raffle tickets over the Internet. Ca raffle registration #RF-0002905."
 
You might consider posting this question in one of the Internet/Cyberlaw forums.

Based on what you've provided, it is impossible to say whether their activity might amount to "cyber gambling" in the first place. What activity do you think might be illegal? What law, what criminal penal provision, is it you think they need to get around? And why do you care?

As far as that disclaimer goes, it is aimed solely at ensuring they comply with s.320.5, which governs charitable raffles. It requires that a raffle cannot be advertised or operated over the Internet, and that "advertisement" does not include the announcement of the raffle on the organization's website. I see no indication from what you've posted that the organization is in breach of 320.5.
