question on child indangerment?

My wife and I have been seperated since 2002. I have moved to Texas since. We had divorce papers drawn up but not signed by both parties for various reasons. Recently, the mother was accused of child neglect by older son from a previous relationship. Social services were contacted and say that the issue is resolved. However, I received a phone call from the grandmother of the child that she felt my daughter was in danger. The child's mother and I are not yet divorced so we don't have current visitation papers drawn up.

My question is where do I begin? We have a new set of papers for our divorce that have been drawn up and we both agree upon, this includes visitation. These papers where agreed upon before this incident happened. I fear for my childs safety since her older brother is no longer living wth her and her mother, and he is not there to watch over her.

Then you need to file for custody of the child. you living out of state though is going to make things harder. Are you able to move back? Time to talk to an attorney. If you feel the child is in danger then you need to call social services and ask for a welfare check.
 
Thank you for your reply and advice. Unfortunately, I'm unable to move back to California. I will call social services today. I cannot afford an attorney at the moment, but I feel that I cannot not afford to get an attorney for my childs sake.
