Dont know how to explain this very well but here goes:

Whats the difference between:

1) One arrest but with multiple convictions of the same crime from different times.

vs

2) Multiple arrests spanning different times and each with a conviction.

Would case #1 be considered a repeat offender? And serve an enhanced sentence or an increase in a charge?

Can case #1's (lets just say misdeamenor) crime be upgraded to a felony due to a multiple conviction?

I'm not sure if my question got through correctly....

Thank you

The arrests don't matter, when it comes to sentencing.
The arrests can't be used to enhance at sentencing.

The only thing that matters is convictions.
More specifically, felony convictions are the determinative factor.

Texas has the three strike rule.
It also matters HOW the prosecutor charges the defendant.
Some prosecutors don't always go with the maximum charge.

Why?
Because the county has to reimburse TDCJ for the people they imprison.
In these tough economic times, some counties use discretion in charging to reduce their expenditures.

One difference in #1 is that the statute of limitations could potentially prevent the prosecution of crimes committed too far into the past.
Under #2 the convictions have been accumulating along the way and everything will be on the record.
