I just had a baby and the guy who believes he is the father wants to take me to court, he says he already signed the papers for him to pay child support and that they are in process right now. When i had him I did not put him on the birth certificate as the father of my child. He says he can change the last name to his and he wants to do that just because, can he legally do that just because he is going to be paying child support? Can the child have both of our last names instead of just his or just mine, if he just wants his. The baby is not even a month old, what will the visitation rights be as well if I am breastfeeding him, I do not want him to take him overnight, especially while breastfeeding. I live in Texas.

Until paternity is established I am not sur eif he has done any of the paperwork he might be bluffing. Did he sign the birth paperwork? He has no naming rights at all but just becauwe you are not married does not mean the baby automatically gets your last name. If you want to hyphenate it that might be a good compromise. You can certainly ask for supervised visits, that is reasonable at this age but as the infant gets older he can ask for unsupervised visits. I think it is great he wants involvement. Kids are much better off with both parents in their life.
