Protecting my daughter from her mom...

My girlfriend and I have had my 4 year old in our care since November of 2007. (When my child was just over a year old her mother left with her and bounced from place to place, hotel to hotel, living on welfare money, using drugs, etc. and eventually ended up in prison.) Now that I have her in my care I am realizing the trauma that she has been put through; homeless, hungry, and neglected. She has been told to call numerous men "daddy" and had been living with a sexual preditor for over a year. She has been subjected to drugs, alcohol, sex, violence, criminals and everything else.

I need to know how to go about filing for full custody when her mother is in prison in another county. Will there even be a court hearing if she is in prison? If so, will we have to travel to that county to go to court? And will my child have to attend? We also believe that we have enough evidence to press charges for the abuse she has put my child through. Now that my daughter has a steady living environment, a place to live, clothes, food, her own room and toys, school, friends, and family I never want her to remember what she has been through. I dont want any possibility that her mom can show up and turn her life upsidown again. Can the court terminate her mothers parental rights while shes in prison?
