My Husband and I were remodeling a house that we intended to purchase from my parents. The house is still in my parents name and they have been paying the utilities and property taxes for the past two years. My husband has done all the work to the house thus far but there is still a tremendous amount of work to do to the property. We have paid for all the supplies. We are currently separated and I plan to file for divorce. I'd like to turn the house back over to my parents but my husband is refusing. Does my husband have any legal rights to the property? There was no contract or paperwork signed on this agreement. Everything was verbal. Can I force him to walk away from the property?
 
If he refuses to leave then your parents will have to evict him. If there was no sale then he has no right to the property. Your parents could potentially owe something for the work that was done, but without a contract the work will likely be considered in lieu of rent.
