How can a landlord when taking a person to small claims court regarding late fees also put down that shes suing for property damages too,BUT the tenant still lives in the rental & is finishing up their last months rent that was paid & the landlord has not even inspected the rental for damages yet nor has she ever been in the rental since the tenants have lived/rented there..?

The plantiff may add anything he/she wishes to suit. It will be up to the judge to decide if its relevant to suit or not
