My name is Joseph C. My girlfriend/fiance' Jennifer T. has a 3yr old named Nick. *hes not mine*. Her ex-husband lost custody of Nick and she has FULL CUSTODY of Nick. He agrees that if she doesn't try to take Nick out of the state of Kentucky that he will NOT try to fight for custody. I currently live in Florida and i've got a great job. She lives in KY obviously. She takes care of Nick and everything but Allan her exhubby treats her like dirt and is always making her miserable. Also her family says that if she tries to take Nick out of the state that they will rally to Allans side and get him Full Permanent Custody of Nick and she will never see him again. ALSO Allan pays child support every month.

My question is this: If she has FULL CUSTODY, can she legally move out of state if she chooses to? and can Allan or the grandmother win custody of Nick with allan having a freakout on his record (he thought he sexually abused nick at 1 yrs old but never did, but its on his record)?? What can we do?

family needs to butt out

she generally cannot move without the court's permission, so if she moves, she risks losing custody. and her family needs to stay out of it, this is between your gf and her child's father only, and legally no concern of theirs. she doesnt need their permission to move.
