A few months ago I was pulled over and later searched and was arrested for possesion of marijuana of less than 15 grams. This is the first offense of anything that I've ever had on my record. Almost a month ago when I appeared for court I was offered a plea to have six months probation. However, the entire time I was there never once was there a mention of a probation officer whether for the whole court to hear or when I had to go up to the judge to sign papers. Also, the court papers I received had no mention of any probation officer at all and I have received nothing in the mail or no phone calls pertaining to a probation officer. Does this mean I have unsupervised probation and if it does, does that mean I'm not required to report since I was informed of nothing of that sort?

You should call them. Ask for the head of probation(if there is one). They should have if you do or do not have to see them on the computer. Not a good idea not to call, and hope by doing so they'll just forget about you.

Odds are you don't have to see an officer, because often times once you are sentenced, you then immediately see the probation officer. Unless you go to jail. . .

I agree with raskalnikov but I have some additional advice. First, if you had reporting probation it would be specified on your court order. It would tell you where and when to make your first report. So I would look there first.

Now out of an abundance of caution, I would go down to the probation office with a certified copy of my disposition from the court. I would present it to the head of probation down there and verify with them that they are not expecting to see your smiling face and $40 every month.

If they say no you don't have to report, ask them to put it in writing that you came down inquiring about reporting and that they said you were on "non-report." If they refuse to put it in writing, and they probably won't want to, I would get home and write a letter to the person that you spoke to outlining your understanding conversation with them. Something like this: As I understand our conversation about my judgment from Judge so and so, it is your opinion that I am on non-report. Etc. Mail that certify, no need for a return receipt.

I know that seems drastic, but you will never regret putting it in writing. My concern is that probation has guidelines. SOMEONE should give you probation rules even if you are on non-report. Rules like, you can't get in any trouble. You usually aren't suppose to drink or use drugs(Duh), etc.

Good luck.

My court papers did state I couldn't get in trouble for the six months but no mention of a probation officer at all. Even the space where it would say I can't leave the state wasn't circled, the only thing the court paper made clear and that the judge made clear was that I couldn't get in trouble for six months but like I said, not one word about a probation officer.

Contact the probation department and ask them.

It could be that this is what we out here would call "court probation" or "summary probation" where there is no direct supervision by a probation officer. Only if you should get into trouble again would it be an issue.
