Alcohol & Drugs: MIP, MIC, Intoxication Probation Violation?

Does anyone know the answer to this question? The situation is this: Young man was convicted (pled guilty) to sending threats over the airwaves (text message threatening to burn down our house, a felony; pled it down to misdemeanor sending threats over the airwaves). Sentenced to 180 days in jail, minus the one day he already served, with the 179 days suspended provided he get a psychological evaluation, attend therapy, get anger management therapy, and I'm not sure what else. Also, my daughter was granted a protective order. He is on probation for a year (ends January 2009). On July 3 this year, he is cited for public swearing/intoxication, which is a class 4 misdemeanor with a fine but is not a jailable offense in Virginia. My question, though, is since he is already on probation, will this violate his probation and will they send him to jail to serve the 179 days they suspended previously?
