My daughters mother passed away unexpectivly in november. We have been working with a lawyer on probate. He mother had a car financed with suziki and alos had a life insurance on the car. we filed all the papers to the insurance and to suzuki finance. The insurance rejected saying she had a pre existing ilness, which was not suppost to cause death but other factors cAused a heart attack. susili had been getting money out of a auto payment account until it dried up. soon as they found no payment came they repo'd the car with no warning. I didnt think they could do that during probabte. they would not talk to my daughter or the lawyer. The repo men opened the garage door at night and took the car and some possisions . talk about rights being violated. police said o well. I say trespassing. also a little curtocy to say make arrandgements to keep paying the car or we will come get it.. Do they have a recourse to get the car back and any right to appeal on the insurance. all was given to the lawyer but she does not seem to have much ambition there.. we have done all the leg work for her.
 
You won't get the car back since mom passed away. The car belongs to the bank, and always has, until paid in full.
You can get the property out of the car though.
I don't expect you will have much luck claiming anything from the life insurance on the auto policy either. I believe that has more to do with death caused as a result of an auto accident, not for pre-existing conditions.
 
thanks. it was expected the bank would take, just the way they did it. My daughter was willing to pay it off or make a deal on existing balance, but it will go to auction and probably make half. o well the banks dont mind loosing, bail outs make them more money then working with customers or estate. they werent even behind, yet other banks let people go months and months as long as they get a payment and lots of interest and penenty fee's.+ can you see I am not in favor of the greed of banks. and we just pay for it both ends.

Steve, the same happened to me, my father passed away when we were young and it was an accident of his car. He has not created any will so my mother didn't get any beneficiaries related to my father. We also have applied to the probate court but all in vein nothing happened. I can understand the feelings of yours.
