I'm on the board of Directors for a local non-profit flying club. The question I have is. Could the board members be sued in the event a insurance claim should not be covered by the corperations insurance company.

Here is the senerio. If a pilot was in violation of the Federal Aviation Regulations, the clubs insurance company policy states that some claims may be denied.

If the claim was substantial or if loss of life had occured on the gound, and the company denied the claim. I'm worried if there could be any possilbity of personal loss to myself as a board member from a suit being brought against the club.

Thanks in advance for any advise you can give me.

Ex - without seeing the bylaws, we can only assume so many scenarios... I suggest that you take your case to a local attorney so s/he can see where the extension of liability due to lack of coverage reaches when it comes to the members of the board of directors. Hope this helps!

Thank you, I talked to my local attorney today and he advised that I should try to get the Articles of Incorporation to see if there is anything written about the liability of members and board members.

Thanks again
