My jurisdiction is: Indiana
A person had 2 prior convictions: charge of operating a motor vehicle with a controlled substance in the body with a minor passenger in the vehicle (class "D" felony, and charge of child nelect (class "D" felony). These were two separate instances occurring on different dates within the same year. In addition, there was another charge of OWI that may have been reduced to a misdemeanor. Now this individual, while on probation, is being charged with 6 counts of forgery by borrowing and 5 counts of theft. Individual on formal probation from priors at the time of the 3rd arrest. One of these charges is Class C and the other is a Class D. If convicted, how much time? Could habitual offender charges be added?
