please help

My husband and I have had our grand daughter since she was two months old.
She is now 7.
My daughter's ex husband is not the father (he is white, the child is bi-racial).
We have been raising her as our own and have always loved her.
My daughter has abandoned her and 4 other children (now adopted by strangers).
My daughter is incarcerated in Louisiana. one of the charges stems from child endangerment. She did not get medical attention for her youngest baby and the baby suffered brain damaged.
She has never provided any support for this little girl.
My husband died last week, never having any solution to this.
I want to have custody of her.
Can I charge her with abandonment and have custody of this child?
The ex husband is remarried and I do not know where he is.
I do have a letter from him, (written 6 years ago), in which he denies that he is this child's father.
What can I do?
 
You can petition for custody of your granddaughter. The father will have to be officially notified prior to any hearing. You may be able to do it yourself, since it seems that no one will contest your petition; however, retaining an attorney is suggested.
