Ok, I really need some help. No one I know is able to answer these two questions for me.

To start off, I am a 17 year old female currently living in Albuquerque, NM. My father passed away when I was 15 years old and I have been receiving Social Security checks due to his passing. I lived with my mother in Texas for a year and I now live in New Mexico with a friend. I strongly believe that my mother (who was my payee for the checks) was wrongfully spending my money. When I moved to New Mexico, for about the first 9 months my mother was still my payee, but I went to Social Security and changed that because of my thinking she was spending my money wrongfully. So I now get my checks. Earlier on, my mother claimed to have "saved" my money for me in a bank account, but a few months ago she told me that there was none of my money left..........that doesn't sound right at all........

I have two questions for you guys...

1. Can I sue my mother for spending my money wrongfully?

2. I am a full time college student, does that mean I will still be receiving my benefits after I turn 18?

I don't really know if you can sue your mother, but I doubt it. It seems that the purpose of survivors benefits for a child is to help compensate for the costs of raising the child due to the loss of the parent's income. If I'm wrong, surely someone will correct me.

To continue the benefits while you are in college, visit this site for information and check with the business office or financial aid office at your college:

I think irish is correct. Your mom is entitled to your SS money since she is the one rasiing you. Ss checks normally are not giving directly to the kids. What your mom does with the money is her business.
