Please Help: I'm in for a battle

My situation: I began seeing a man in February of 07, raped by a producer in March and found out I was pregnant in April. I broke up with the man I was seeing because he was involved in criminal activity, very verbally abusive, and had 4 children that he owed thousands in child support. He used me to rent out an apt for him in my name because his credit was messed up and license taken away from owed child support.The situation is that either guy could be the father and they are both SCUM.

I moved on, cut contact with these guys, started back in school and had my baby. I have been taking care of my son since he has been born. Neither man has sent one penny or a piece of lint to my son. The guy I was seeing sent me court papers for ligitimation and joint custody.

My concern is that this man would be a terrible role model! he has been in and out of jail, deals drugs, verbally abusive, and a scam artist. How do I get the information about his background? Is it possible for him to win with a criminal record and the fact that he owes so much in child support? What do I do if I don't want this thug nowhere around my son?
 
We cannot predict the outcome of the case although it appears it favors you. Your poor judgement in men may or may not come into play as your past as well. Neither man can file for custody nor can you seek support until paternity has been established unless you named Father and he signed Birth acknowledgement
 
He nees to establish paternity first. I am wondering why he even bothered serving you. Until paternity is established he has no rights. If I were you I would not file for any child support or public assistance and raise the child on my own but now that he has served you, you have to repond. If you get narried you can ask for a termination of rights and for your husband to adopt but until then, you may have a hard time keeping this man away if he wants involvement.
 
It's not hard to conduct a background check on a person, so long as you have a few facts including birthdate. My county also has a "jail registry" to see who has been locked up in the past year.

Google "background check" and do due diligence on your findings, you'll come up with a few reputable choices. Unless his crimes were very severe and against children, it's unlikely to affect his rights to your child, presuming it's his.

Non-payment of CS is not a factor in determining custody and/or visitation.
