My jurisdiction is: Pennsylvania
My children were taken from me in October 2004 because I was testing positive for amphetamines and methamphetamines. I told them that I was taking sinus medication, ephedrine, but they said that it was not possible to test positive because of that. However, there are many internet sites that will tell you that they will. CYS used a urine dip test and I know that in criminal court if you test positive on this type of test that the results have to be confirmed by another type of test before the results can be used against you. The one time that they did have the urine test sent to a lab for confirmation it came back negative and they told me that it just meant that there wasn't enough in my system for a "full blown positive". It has been almost 3 years since I have had any positive results and the courts have just ruled to have my parental rights involuntarily terminated. What can I do? I am in no way claiming to be perfect but they took my children for taking an over the counter medication.
