My jurisdiction is: Indiana

9 Years ago someone I know was picked up on a Public Intoxication charge, after doing everything that was required by the court case was closed. A few days ago this person was picked up on a DWI (both offenses occurred in Indiana). My question is can the prosecutor fault him/her as a repeat offender or will it not have very much impact because both cases are misdemeanors. I am not familiar with the laws regarding the state of Indiana! Please help

Assuming they were not a juvenile when the first offense happened, then it is on her record. However, most states have laws for multiple DUIs/DWIs/whatever they call them in that state. However since the first offense was public intoxication, it really wouldn't be a repeat offense, because the first time was not while driving.
