My daughter is a cheerleader. A photographer has taken pictures of all the cheerleaders and posted them on the football leagues site. This person has put a link on the football leagues site. His web address is not a registered domain, so I'm assuming that's why they are posted there. Once you click on his web address, it takes you to shutterfly.com We saw him taking pictures and thought he was with the locaL newspaper. I never signed a release or gave him written nor verbal permission for anyone to take my child's pictures. I found out through the coach that the pictures were posted several days after, and he is selling them. I tried to click on the picture to copy it and he has it copyright protected. Is this illegal ??

You or your lawyer should write the bad people and tell them to take the picture down.

It is most likely legal since you cannot prove any criminal intent with the pics, and he is the owner of the pics so he does have the right to copywright them. You can certainly email him and request him take your daughter out of the picture.
