I live in and work in North Dakota. North Dakota, evidently does not recognize non compete contracts.
I have been hired by a company in North Dakota, that has a home office out of state (Minnesota)
Can this company legally force employees in North Dakota to sign a non-compete before hiring, and furthermore, state in this contract that any arbitration be done in a Minnesota court of law?
This contract also prevents working in "software development," for a period of one year, in the largest city in North Dakota. (The company I signed this contract with is not even in the same city, in fact is 60 miles away) Doesn't this infringe on ones right to make a living?
Also, this company seems to only "selectively" enforce the non-compete. They have not challenged people who move to Microsoft, but have challenged other "small companies." Isn't this some type of discrimination, and shouldn't a non-compete be applied universally?
What are my options on this issue?
