I work in a school system (not-for profit) and we have the option of having our paycheck for the 10 months or spread over 12 months. I chose to have my pay over 12 months. I have completed my work time and now have the summer off. I am pregnant (due date 8/15/08) and I qualify for medical disability at this time. Later I will apply for disability for birthing and recovery. My job states that if I take anyform of disability now, I will lose my pay and receive just the disability pay. Is this legal? I have already worked the school year (ended in June). Had I chosen the 10 month pay I don't think this would be a question. How should I proceed, what are the laws or advice. Your legal expertise is greatly appreciated!
