Hi there~ I recently had to file a motion to vacate default judgment/& declaration with the court, Due to not being served the courtdate after I had already filed my response(s) & did them correctly. What I need to know/understand about it is, Will the motion I filed put a temporary stop to my garnishment? If not what will? ***Note...If you cant post back here to me on this, would you be so kind as to post back using my email? I don't know the rules of civil procedure of your unnamed jurisdiction, but filing the motion to vacate may not stop your garnishment. Often applicants will also need to file an application for a stay of execution or similar, prior to the hearing of your motion itself. You should consult with a local attorney. Duty counsel at court or the court clerk may be able to assist you.
