Not permitted to leave the premises

The company I work for, located in TX, recently came out with this new policy due to possible liability:

Hourly, non-exempt employees must remain on company premises while you are clocked in.
If you leave the premises for any reason (even on breaks), other than approved company business, you must clock out.

I know that DOL states that "it is not necessary that an employe be permitted to leave the premises if he is otherwise compeltely freed form duties during the meal period". My concern is the distinction between exempt and non-exempt employees. Does this policy unfairly discriminate against hourly employees by forcing them to stay while allowing exempt to leave?
 
No, it does not. It is quite legal (in all states) to have different rules for exempt and non-exempt employees.
