I was wrongfully charged of shoplifting at a Walmart. The police gave me a summons to show up incourt and just yesterday I received a civil demand from a Walmart lawyer.
What should my next step be? I can't afford a lawyer, and I was told that I am unable to receive a public defender until I am given a court date.
Every criminal defendant I've ever represented felt the criminal charges lodged against them were not in compliance with the law.
In reality you're a criminal defendant, who, under our laws is innocent until proven guilty.
So, you plead not guilty in court, absent the ability to hire a lawyer, you must plead guilty or become your own lawyer.
That means you convince the judge (don't do it here) of your innocence by telling how you were wrongfully arrested and subsequently charged.
As far as the DEMAND for tribute letter, some say pay, others say throw it away. What you do is your call. If you fail to cough up the extra loot, you'll be hounded relentlessly to pay, your credit will be dinged, your mailbox inundated with "pay up deadbeat or else"!!!!!
Yeah, good luck with that.
When this sordid affair ends, for your sake mate, OBEY ALL OF THEIR LAWS, otherwise they'll endeavor to ruin your life (and you'll be making it easy for them)!
