We purchased a new construction last May. A few months later the basement flooded several times during heavy rain. The builder repaired the damage, regraded the yard, and raised the bilco door so that the water could not enter as easily.

This has improved the situation but we are still getting water though it is not flooded. The job he did was not completed and was not done correctly.

He has had a lot of excuses and we now would like to take legal action. However he is basically out of business now. He was set up as an Llc. In this situation could we sue him personally for negligence since he did the repair work? Are there any other options?
 
Hire a lawyer and sue everyone who had anything to do with this.

But, since you said he went out of business, I doubt you'll ever receive a penny.
