New Construction Contract - date loophole?

Help! I signed a contract about 6 months ago to build a home. I was pre-approved by the builders mortgage company for a mortgage at that time, however, my financial circumstances have changed and there is pretty much no way I will qualify for this mortgage. I have read over the contract and there is a provision in there stating that if financing is not approved due to fault of the purchaser then I lose my $15,000 deposit that I have already put down. My question is this - when i signed my contract I was told to back-date it. I have e-mails from the builder from the beginning of May that state I need to sign the contract with a date of 4/28/2006. This is on several correspondence. Does this make the contract voidable?

I'm desperate and want my 15K back!

A: It's possible; hire a lawyer.
