Neighbor's tree fell on My House

During a small rain storm this past Tuesday a tree from My neighbor's lot fell on My house. There is a fair amount of damage to my roof. Does the owner of the lot have any liability in a case like this? I spoke to him a while ago about exactly this scenario, and offered to cut the trees but he refused.

I live in Flagler county, Florida.

It depends. If the tree was damaged or posed an immediate danger and you can prove the owner knew about it you have a good small claims case. Proving something that was only verbal is a problem. Next time put it in writing CRRR.
