Background: I live in Oklahoma. My son is a happy and healthy 6 year old. Has a daddy that loves him very much, and wants to adopt him. Well the biological father hasn't seen or talked to my son since he was 8 months old. I talked to him for a couple of months after he left via email, then he disappeared. Hasn't ever paid child support. Child support enforcement couldn't even find him. Then last December, he called my parents looking for me. My dad gave me the number. I decided to call him to see what he wanted. Then he told me about what he's been doing for the past 4 years. Well he gives me this song and dance about how he was looking for me. He said that he joined the military went overseas somewhere blew out his knee and got discharged. But couldn't give me a branch name or his discharged papers. I don't know if he has to supply that information to me. So I talked to him again via email for a couple of weeks and haven't heard from him since the end of December.
Question: Why do I have to petition for his rights? Why does he even have rights? Are those forms that I can buy online for the step parent adoption legit? This is the only thing that is holding us back from moving forward to my husband to adopting my son. We can't afford to hire a lawyer.
