need some help on resolving my husband/ ex wife situation

my husband and his ex wife have been divorced for three years now. since then he has traded in his truck to get her name off if his truck. he is still on her truck as the primary and she will not take him off by qualifying for the loan on her own. we have asked her several times to refinance the truck into her name and she has found an excuse each time not to do it. since the divorce she has managed to get into two accidents and has had a delinquet payment. se have tried and tried to work with her, but do to the fact that in their papers it does not state that the truck needs to be placed into her name she wont do it. How can we possibly handle this situation? or are we screwed? We just dont want to be responsible for that one accident or that one payment she decides not to make. Please help?

Technically if the decree does not state she has to refinance, then she doesn't have too. When this stuff is left out of decrees it can really screw people.

Your husband is probably going to have to file in court to request she refinance the truck however if her credit is bad, she probably won't.
Was she specifically awarded the vehicle in the decree? If not, then if his name is on it and he has keys to it then he can take the truck from her.

If she was awarded the truck and he still takes it, she could file a comtempt charge in court.
