12 years ago my son meet this girl. They were young 16 and 17. A child was conceived. This child is almost 11 years old now. When this child was born my son signed the birth certificate and they got married when he was 2 months old. The mother never said anything to him about their was a chance he was nott he biological father. They divorced in 2003 and nothing was never said about the child not bing his. They have joint custody of the children and this boy actually lives with him full time and sees his mother frequently.
Fast forward to December this guy contacts the mother and tells her that he wants a DNA test to prove this child is his and wants to be actively involved in this childs life now that he has located them. This guy contacted the district attorneys office here in Texas to establish paternity and to start the process of child support. The mother has informed my son of these actions and has told my son that she believes this guy is the father and that she could just never be truthful with my son. So now they have a hearing next Tuesday to start the establishment of "parentage" as they are calling this.
My son hsa contacted the Texas Child support office and explained to them that he is the father of this child and has been this childs father since he was born almost 11 years ago. Child Support office was very rude to him and told him that she because he signed the birth certificate does not make him the biological father and this guy has the right to determine "parantage" They said that they did not have an Acknowledgement of Paternity on file for this child and that needed to me signed since he was not married to the mother at the time of birth.
We are all upset thinking that we are going to lose him. What can we do? They are going to this hearing on Tuesday and hey are going to get a dna test ordered. What happens if they find out this other guy is the father? Will my son have any rights to this child? Can he fight for custody? Most importantly can we stop this from happening?
